She's unhappy because she though she could just keep pulling the scam indefinitely. IT take people fighting back and this board is MORE THAN HAPPY to help you in the fight. She needs to pay you guys instead of special her bitch. The next thing I hope to see is those letters to the Attorney General in Michigan and more BBB complaints. Please have the gentlemen from India also do the same. We can get his money back. AKC is investigating whether she roistered the dogs correctly in the first place since she use a man in his garage to do the chilled semen. The guy was NOT a re pro vet nor even a vet tech at the time. He's also been reported for practicing vet medicine without a license's. His name is Dean Bitzel. Keep fighting for your money and we will keep helping.

I do want to thank Teresa for her help here with the Angie Fish scam and lies, as I was pretty much the only one getting hit by the other side on the other forum because of me speaking out on her lying about me and trying to help others that were scammed...

Chilled or frozen has to be approved by AKC..  Not necessarily a Vet...

Having computer difficulties....    The place etc, has to be approved by AKC.   Not necessarily has to be a Vet doing the collection or freezing or chilling...

Correct, but the paperwork has to reflect who did the insemination and it has to be the person who did it.

Tara tried to call me today and left a message. I'm working midnights right now, so getting in touch with me during the day is pretty rough. Anyway, she states that she is being lied about and that the information posted is not correct. She says she can prove one person who posted has been paid in full. I called her back and left a message for Tara. Basically, it says that she may join the forum and state her case with her documentation. After all, my point isn't to falsely accuse or hurt anyone. It's simply to help those that are being wronged get their money back. Tara does have the opportunity to defend herself and document her stance, but it's up to her to do so. Whether or not she chooses to do so is up to her, but I don't take anyone's word for it. I hope she realizes that.

Below is the letter we sent to the Michigan Attorney General requesting that they open a case against Tara Smith for defrauding puppy buyers and fellow breeders.  She has found the perfect way to make money because not refunding deposits has to be remedied through civil court (small claims) versus criminal court.  Puppy buyers in other states or internationally who get stiffed by her not refunding their deposits will not travel hours or days to try to get their money back through small claims court.  We had added a clause to the contract/agreement that our deposit was refundable so there was no non-refundable clause.  She also chose not to claim the certified letter we sent to her demanding payment as we had every intention of getting our money back through the small claims process.

 

We spent many hours working to get our deposit refunded but even worse was the time we wasted with her that prevented us from pursuing a puppy from a reputable breeder.  We lost our big guy, Balzac, in 2010 to a horrible MRSI infection and we were so looking forward to getting a new puppy.  Unfortunately we ended up spinning our wheels with an unethical breeder who tried to cheat us by playing on our grief.

 

Letter to Michigan AG:

I contracted with Tara Smith on May 28, 2011 for thepurchase of a puppy and sent her a $500.00 refundable deposit.  I requested to add a clause to the contractthat my deposit would be refunded immediately if any of the puppies in herlitter contracted any infectious disease. Ms. Smith agreed to this language and added the clause to thecontract.  Ms. Smith sent me the contractwith the additional language from her workplace computer at the LakelandCorrectional Facility in Coldwater, MI.  Inearly July 2011, Ms. Smith informed me that the puppies had contractedpneumonia and were on antibiotics.  Aftermuch thought I contacted Ms. Smith and told her that I did not want to take apuppy from this litter and wanted my $500.00 deposit refunded.  Ms. Smith agreed and sent a check for$500.00.  I deposited the check in mybank and on August 9, 2011 was informed by my bank that Ms. Smith's check hadbounced.  I tried to contact Ms. Smithand received no response.  I sent her ademand letter for the refund of my $500.00 by certified mail which she refusedto sign for.

I have since been in contact with numerous people who have alsoexperienced receiving bounced checks from Ms. Smith for contracted services todeliver puppies from her litters or for fees related to her breedingprogram.  There is a pattern of checkfraud by Ms. Smith related to her dog breeding activities.

I would like to file this complaint so that Ms. Smith cannotcontinue to defraud potential buyers of the dogs she breeds.  I can supply the names of the people she hasdefrauded with bounced checks in order to build a case against Ms. Smith.  She defrauds people in other states andinternationally knowing that they either cannot or will not file formal chargesagainst her through the small claims court process.  She is earning income and not paying taxes bytaking deposits from her puppy buyers and not delivering the puppy to thebuyer.

I would like to request that your office begin aninvestigation into Ms. Smith's finances and practices related to her dogbreeding activities.

We were the ones Tara refers to to that got paid.  However, it's not as straight forward as she states.  We had to badger her to send us our refund and she finally sent us a check for our $500 deposit - the check bounced and she would not respond to our further inquiries to make it good.  Fortunately my husband owns a business so he knows how to work through getting paid by someone who bounces a check.  Your bank will send you a copy of the check that bounced - this is a real live check so do not throw it away.  You call the person's bank that the check is drawn on and ask them if there are sufficient funds in the account.  The bank cannot tell you what the balance is but they can tell you that if you deposit the check now it may clear.  My husband called her bank and the first three days there were not enough funds in her account.  The fourth day there were funds available - you then take the copy of the check immediately to your bank and deposit it.  Then you wait to see if it clears and hope other checks were not drawn on the account before yours.  Our check cleared.

 

We got our money back with absolutely no help from Tara.  I'm sure that this is what she did to everyone else she owes money to.  If she had such good intentions about paying people back why did she avoid any contact with us and only when the pressure is on from reputable breeders she comes clean.

Thank you Deborah. It sounds like you beat her at her own game. She was wise not to close the account because that would have been a much bigger crime (in the eyes of the system) though in my opinion, keeping puppy deposits for any reason is a big deal. I am glad you got yours back. I hope everyone will.

Another great suggestion by a poster (to me privately). If you are owed money by any breeder, fill a bad debt write off with the IRS and send the breeder the appropriate form. They will have to pay taxes on it. If they don't, then they get the full power of the IRS on them. It may not get all of your money back, but it can at least soften the blow by getting a tax credit.

I'm not a tax guy, but before you can write off a debt for tax purposes, you have to make a verifiable attempt to collect on the debt, and the determine (per the IRS guidelines) that it is not collectable.

Sending a demand letter via certified mail is one way that would probably satisfy the IRS in the event YOU ever got audited and this particular item ever came up.

That has been done. Good thing about being audited is that if you have done everything by the book, you have nothing to worry about. The people that are trying to get their money back have send certified letters (which were NOT claimed by the accused), filed with the AG and the BBB. In other words, they have done everything by the book.

We are closing in quickly on the end of the 2 week period in which it was promised that everyone would be repaid.
